Summary judgment. The order appealed from denied the motion of the city of Milwaukee for summary judgment dismissing the complaint
of Charles A. Laffey. On a previous appeal this court sustained the complaint against the demurrer of the city of Milwaukee.
Laffey v. City of Milwaukee, 1958, 4 Wis. 2d 111, 89 N.W.2d 801. The city has now answered, denying certain allegations in
the complaint and pleading special defenses. The complaint in substance alleges Laffey sustained injury on January 28, 1955, when he fell on a slippery sidewalk in front
of the premises at 5132 West Center street in Milwaukee, Wisconsin. For a substantial period of time prior to January 28,
1955, the city through its employees caused such sidewalk to become defective and dangerous for pedestrian travel and permitted
a continuance of such defective condition. In the notice to the city which is attached to the complaint and made a part thereof
it is stated that the unusually slippery spot of ice accumulated through the acts of the Milwaukee city fire department and
said ice was negligently allowed to remain upon the sidewalk by the city for an unreasonable length of time.
